Mills v. US and Doyon et al. Jamie Linxwiler and Josh Van Gorkom of Guess & Rudd P.C. will discuss a very interesting RS 2477 case now on appeal to the 9th Circuit. The case presents a broad spectrum of legal issues, including mining law, ANCSA, and the finality of patents. But mostly it is about RS 2477 in general and, specifically, private party standing to bring RS 2477 claims - one of the current topics in RS 2477 case law. Doyon and the US prevailed, and the miner, as a private claimant of a public right, was held not have prudential standing to bring a RS 2477 claim.
