Administrative Law

Alaska Native Law

Transitions in Election Processes at Annual Meetings of Shareholders.  Several Alaska Native Corporations have changed their director election processes during the past several years.  Marcia Davis and Norm Resnick, in-house counsel for Calista Corporation, will discuss recent changes to bylaws and election procedures passed by Calista's Board of Directors which have modified Calista's director election process.  1 General CLE Credit.  Phone-ins from other locations in Alaska are welcomed and encouraged.

Alternative Dispute Resolution
The ADR section will meet on Thursday, March 14, 2013, at 12 noon at the Bar office, 840 K Street, Suite 100, small conference room.  Workers’ Comp Law members are invited. 

Legislation on Mediation of Workers’ Comp Cases.  This meeting will feature a review and discussion of legislation introduced in Juneau regarding the mediation of workers compensation cases.  The legislation includes current SB 35 regarding Workers Comp Mediation and SB 116 which is similar and was in the last session. Fred Brown is the guest speaker.  Fred is a retired 25 year Workers Compensation Hearing Officer and current Executive Director of the Health Care Cost Management Corporation of Alaska.  1 General CLE Credit.   Phone-ins from other locations in Alaska are welcomed and encouraged.

Corporate Counsel

2012 Family Case Law Update Continued:  Alaska Supreme Court Cases.  Co-chair Whitney Bostick, Law Office of Carl Cook, will continue the discussion started at the February meeting on a review of Alaska Supreme Court cases pertaining to family law topics.  Remaining cases to be reviewed include, time permitting: McLaren v. Federal Agency & Congressional Practice Law
This new section meets on the third Friday of every month.  The next meeting will be on Friday, March 15, 2013, at 4 p.m. in Washington, D.C. at SH-709 Hart Senate Office Building; and at noon in Anchorage possibly by video conference, location TBD.  All other locations will be by conference call. 

Working with the Alaska Congressional Delegation.  It is anticipated that the chiefs of staff for Sen. Murkowski, Sen. Begich and Cong. Health Law

HIPAA Omnibus Rules – The BIG Changes.  Stephen Rose, Chair of the Healthcare Law Department of Garvey Schubert Barer, will be the guest speaker.  This presentation will offer a very high-level view of the major HIPAA changes brought about by the HIPAA Omnibus Rules published in the January 25, 2013, Federal Register: 1) The New “Harm” Standard: determining when an “incident” becomes a “breach” requiring notification; 2) Business Associates: Applying HITECH privacy and security rules to business associates and subcontractors; 3) Changes to Notice of Privacy Practices: A review of the mandatory changes to the standard NPP and 4) Enforcement and Civil Monetary Penalties:  OCR carries a bigger stick (time permitting).  1 General CLE Credit.   Phone-ins from other locations in Alaska are welcomed and encouraged.

Pro Bono Legal Work in Africa.  Reagan Demas of Baker & McKenzie, Washington, DC (see short bio) will be the guest speaker.  Mr. Demas will discuss issues related to doing pro bono legal work in Africa, specifically work that he has been involved in with regard former conflict areas in Sudan; post conflict work; and regarding HIV laws in various Eastern African countries.  1 General CLE Credit.  Phone-ins from other Alaska locations are welcomed and encouraged.
