Administrative Law
The Administrative Law section meets quarterly. The next regularly scheduled meeting is December 3, 2012, at 12 noon at the Bar office. 

Juneau Members:  You can attend section meetings at the Department of Law in the Dimond Courthouse (123 Fourth Street), 5th floor conference room.  Because the 5th floor is secure, access the meeting by going first to the department’s reception area on the 6th floor, opposite the main elevators. This location will be connected by conference call.

Alternative Dispute Resolution
The ADR section will meet on Thursday, October 11, 2012, at 12 noon at the Bar office.

Association for Conflict Resolution Conference Update.  Guest speaker Karen Largent will report on the recent ACR conference in New Orleans. A write-up by Judge Herb Ross will be included.  .5 General CLE Credit.

Appellate Law

Bankruptcy Law  
The Bankruptcy Law section will meet on Tuesday, October 30, 2012, at 12 noon in the U.S. Trustee’s Hearing Room in the Bankruptcy Court, 605 W. 4th Avenue.

Consumer Case Law Review and Update.  Attorney Chris Johansen will give a presentation on "consumer Case Law Review and Update" focusing on Ninth Circuit, 9th Cir. BAP, and local decisions of interest concerning consumer debtor cases.  Future meeting topics and chairperson opening(s) will also be discussed.  1 General CLE Credit.

Business Law  
The Business Law section will meet on Tuesday, October 16, 2012, at 12 noon at Lane Powell, 301 W. Northern Lights Blvd., Suite 301.

Corporate Counsel
The Corporate Counsel Law section will meet on Wednesday, October 17, 2012, at 12 noon Stoel Rives, 510 L Street, Suite 500.

Elder Law
The Elder Law section will meet on Wednesday, October 17, 2012, at 12 noon at the Bar office.    This is a one-time day change due to Alaska Day on the regular meeting day. 

Consumer Protection and the Elderly - The Elder Law section is very fortunate to have special speaker *David Horn with us this Wednesday, October 17th at noon in the Alaska Bar Office. Included in his presentation, he will be speaking about consumer protection issues and scams targeting the elderly.  1 CLE Credit. 

*Dave Horn is Assistant Regional Director of the Federal Trade Commission’s Northwest Region, which includes Alaska, Washington, Oregon, Idaho, Montana and Wyoming.  The FTC enforces consumer protection and antitrust laws, frequently working with state attorneys general and other enforcement agencies. The FTC also works to educate consumers to better protect themselves. Dave joined the FTC in 2005 after 18 years with the Washington State Attorney General’s Office and two years in private practice in Seattle. Dave is a graduate of Whitman College and Harvard Law School.

Employment Law
The Employment Law section will meet on Wednesday, October 3, 2012, at 12 noon at the Bar office. (After cancellation of September’s meeting due to the windstorm, the section is presenting last month’s topic.)

Surreptitious Taping in the Workplace:  Is it Lawful, Ethical, and Admissible?  Gregory Fisher of Davis Wright Tremaine and section co-chair, will discuss the legal, ethical and practical issues related to surreptitious taping in the workplace.  Tentatively 1 General CLE Credit.  Ethics credit will be determined after the meeting.  Phone-ins from other locations in Alaska are welcomed and encouraged.

Estate Planning & Probate Law
The Estate Planning & Probate Law section will meet on Tuesday, October 9, 2012, at 12 noon in at the Bar office.  Real Estate Law section members are invited. 

Uniform Real Property Transfer on Death Act.  Nat Sterling, Uniform Law Commissioner and chair of the drafting committee, and Turney Berry, also a member of the drafting committee (an estate planning and probate attorney from Kentucky), will present. Family Law
The Family Law section will meet on Tuesday, October 30, 2012, at 12 noon at the Bar office.  NOTE:  This is a one-time date change!  It is expected that the regularly scheduled meeting on November 6, 2012, will still be held.

Health Law
The Health Law section will meet on Thursday, October 4, 2012, at 12 noon at the Bar offices. 

Patient Protection and Affordable Care Act - The 60-Day Clock is Ticking.  Now What??  Co-Chair Barbra Nault of Bankston Gronning O’Hara PC is the guest speaker. The Act requires health care providers to report and return Medicare and Medicaid overpayments within 60 days of the date the overpayment is identified or the applicable cost report is due.  The Centers for Medicare and Medicaid Services issued a set of proposed regulations for the Medicare program in February 2012 (the third set so far related to overpayment recovery).  The proposed regulations sparked a lot of discussion, but there is still no final rule on implementation.  With providers facing potential False Claims Act liability for violating the repayment provisions in the Act, the million-dollar question (no pun intended) is what to do if a potential overpayment is discovered. 1 General CLE Credit.  Annual elections will be held briefly.  Phone-ins from other locations in Alaska are welcomed and encouraged.

Immigration Law
The Immigration Law section’s next meeting with the DHS  on Thursday, October 18, 2012, has been canceled due to the unavailability of the USCIS Field Officer.  Watch for further emails on rescheduling of the following topic: 

 To Be Rescehduled:  Deferred Action for Childhood Arrivals (DACA).  The October meeting will be with USCIS Field Office Director Bernadette Nocerino-Doody.  Under the DACA plan, eligible young undocumented immigrants who pay a $465 application fee and receive approval from U.S. Citizenship and Immigration Services will be given legal authorization to work and a two-year deferral from deportation.  To be eligible, immigrants must be younger than 31 and have arrived in the United States before age 16 have resided continuously in the U.S. for a minimum of 5 years prior to June 15, 2012.  They must also have no criminal record.  1 General CLE Credit.
