Administrative Law
The Administrative Law section meets quarterly. The section’s next meeting will be Monday, December 5, 2011. 

Juneau Members:  You can attend section meetings at the Department of Law in the Dimond Courthouse (123 Fourth Street), 5th floor conference room.  Because the 5th floor is secure, access the meeting by going first to the department’s reception area on the 6th floor, opposite the main elevators. This location will be connected by conference call.

Admiralty Law
The Admiralty Law section meets quarterly.  The next meeting will be Thursday, November 10, 2011, at 12 noon at the Bar office.

Roundtable Discussion.  The discussion will focus on local orders and on slip opinions issued nationwide since the last meeting, addressing maritime personal injury, punitive damages, and other issues pertinent to Alaska.  1 General CLE Credit.

Alaska Native Law
The Alaska Native Law section will meet on Wednesday, November 9, 2011, at 12 noon at the Bar office.

Leisnoi, Inc. Recall.  The shareholders of Leisnoi, Inc. recalled their board of directors at a special meeting held June 14, 2011, by a vote of more than 58% of all voting shares.  The sitting board challenged the validity of the meeting, and Judge Pfiffner on October 7 granted summary judgment as to the validity of the meeting and entered a preliminary injunction transferring control of the corporation to the new board.  Jahna Lindemuth, a partner at Dorsey & Whitney, will share the story from the point-of-view of the lawyer litigating the case on behalf of the shareholders who called the meeting and were elected to the new board, and Jana Turvey, whose day job is General Counsel for Ahtna, Inc., will tell the story from the perspective of a shareholder leading the recall effort.  1 General CLE Credit.

Alternative Dispute Resolution
The ADR section will meet on Thursday, November 10, 2011, at 12 noon in the Bar office.

Ethical Implications in ADR Practice.  Have you ever wondered what ethical implications are presented in your ADR practice by various forms of social media?  Has a participant ever presented information about another participant from social media?  Can you “friend” someone who will be a participant in a mediation, arbitrator or other ADR matter?  Do they have information about you from a social media posting? Can you “friend” other attorneys who might at sometime participate in your ADR sessions?  Come to the next ADR meeting for a presentation by assistant bar counsel Louise Driscoll and Mark Woelber for an interesting presentation on the ethical implications of social media in your ADR practice. 1 Ethics Credit.  ADR books now available for self-checkout at the Bar office.

Appellate Law
The Appellate Law section and New Lawyers section will jointly meet on Thursday, November 17, 2011, at 12 noon at the Department of Law, 5th Floor Conference Room, 1031 W. 4th Avenue.

Tips from the Top.  Alaska Supreme Court Justice Morgan Christen, Alaska Court of Appeals Judge Joel Bolger, and Clerk of Appellate Courts Marilyn May will appear in a question & answer panel moderated by Lloyd Miller to share their views on how new Alaska lawyers can learn the ropes in appellate practice and how experienced appellate lawyers can keep up and hone their skills. Members of both sections are encouraged to submit written questions for the panel in advance.  The panel will try to address as many as possible within the available time.  Please send them to JoAnne Baker at bakerj@alaskabar.org. 1 General CLE Credit.

Bankruptcy Law  
The Bankruptcy Law section will meet on Tuesday, November 29, 2011, at 12 noon in the U.S. Trustee’s Hearing Room in the Bankruptcy Court, 605 W. 4th Avenue.

       Coffee, Cookies and Keeping Current - U.S. Trustee Update.  Kay Hill, Assistant United States Trustee, is providing the first two and  discussing the third on:  Rules and forms changes effective 12/1/2011; Analysis of fees currently being charged by debtor’s counsel and to Chapter 7 trustees; and Recent UST cases.  1 General CLE Credit.   

The section’s annual Bean-a-Fit is Friday, December 9 from 11:30 a.m. to 1:30 p.m. at the Bankruptcy Courthouse.  More details will be in the December newsletter.

Corporate Counsel
The Corporate Counsel Law section will meet on Wednesday, November 16, 2011, at Stoel Rives, 510 L Street, Suite 500.

Arbitration Essentials With the AAA.  Many in-house counsel know in their gut that arbitration is the most cost and time efficient way to resolve disputes and frequently incorporate it into their contracts. They often invoke the rules of the American Arbitration Association (AAA) or its arbitrator selection procedures.  But do you really understand what the AAA rules and procedures are? Have you used the correct contract language that AAA can honor and undertake to perform? Do you know what other services the AAA, a non-profit entity, provides at little or no cost? This includes mediations, holding elections, reviewing employment dispute resolution clauses to ensure they meet due process protocols, and other neutral services.  Dwight James, Vice President of the AAA in Los Angeles, is responsible for Native and Northwest issues resolution.  He will join us telephonically and share his insights into the AAA and how in-house counsel can best utilize ADR to design a dispute resolution process that fits the individual needs and concerns of your company.   1 General CLE Credit. Elder Law

The Employment Law section will NOT meet in November.

Health Law
The Health Law section will meet on Thursday, November 3, 2011, at noon at the Alaska Bar office.

Litigation update.  This meeting will include speakers presenting information about Psychrights, recent Medicaid audit appeals and health reform litigation. 1 General CLE Credit.

Immigration Law
The Immigration Law section will not meet in November.

However, it will meet on Thursday, December 1, 2011, at 12 noon at the Anchorage Department of Homeland Security office - 620 E. 10th Avenue. The December meeting will be with Bernadette Doody, Field Office Director, U.S. Citizenship and Immigration Services.  A follow-up will be sent to members regarding areas to be covered.

International Law

Law and Community Health Forum    
The Law & Community Health Forum will meet a week later in November - on Monday, November 14, 2011, at 12 noon at OPA, 900 W. 5th Avenue, 3rd Floor.

Behavioral Medication.  Dean Konopasek, Ph.D., is the guest speaker.  Dr. Konopasek is chair of the UAA College of Education, Department of Counseling and Special Education (CASE).  His book, Medication Fact sheets:  A Behavioral Medication Reference Guide for Educators, 4th edition (2012), provides a reference for teachers, psychologists, social workers, counselors, and other professionals who work with children, adults, and seniors with psychiatric and emotional disorders. Social Security Disability Advocacy    
The Social Security Disability Advocacy section will meet on Monday, November 14, 2011, at 12 noon in the Bar office. 

Recent Social Security Rulings.  Co-Chair Paul Eaglin will lead the discussion on these topics:  1)  The practical implications (including malpractice exposure) of Social Security Ruling 11-1p, issued as a Final Rule effective upon publication on 7/28/11; 2)  the Notice of Proposed Rulemaking issued in mid-September where SSA indicates they are eliminating Step 4 in the Sequential Evaluation Analysis in some claims; 3) the recent indication by SSA of its re-conceptualizing disability claims from young adults; and 4) topics for future meetings.  View the handouts for the meeting.  1 General CLE Credit.

Tax Law
The Tax Law section will meet two times in November. 

1) The first is the section’s regular meeting on Wednesday, November 9, 2011, at 12 noon in Room 1270, Atwood Building (same building as Bar office). 

NYU Tax Conference.  Co-Chair Chuck Schuetze will discuss recent tax developments covered at the October 2011 New York University 70th Institute on Federal Taxation. 1 General CLE Credit. 

2) Then on Friday, November 18, 2011, at 12 noon in Room 240 (1st set of elevators), Atwood Building, the Tax Law section will meet jointly with the Estate Planning/Probate Law and Business Law sections.

Torts/Personal Injury Law
The Torts/Personal Injury Law section meets every odd-numbered month.

The next meeting of the section will be on Tuesday, November 15, 2011, at 12 noon in Room 1270 of the Atwood Building. Note the one-time location change.

Unbundled Law    
The Unbundled Law section meets three times a year for 1.5 hours (12 noon to 1:30 p.m.). The next meeting will be held on Friday, December 2, 2011, in the Bar office.  It will be a replay of the first half of the 2007 CLE “Unbundled Legal Services: Creating a Profit Center Using Limited Scope Representation in Your Civil Practice.”

Workers’ Comp Law
The Workers’ Comp Law section’s next meeting will be Friday, November 4, 2011, at 12 noon in the Bar office.
