The Lawyers’ Assistance Committee (LAC) provides services to members of the Bar when it appears they, their families or colleagues are suffering from substance abuse. Most lawyers don’t know who they can turn to who will understand the unique challenges of fulfilling their duties as a lawyer while trying to retain control of their lives. Views from a Family-Oriented Therapist. The guest speaker will be Allen Levy, a private practice therapist. Some of his areas of family-oriented practice include expert witness, court-ordered therapist, co-parenting facilitator and custody investigator. Intellectual Property Law

IP Issues in the Recording and Music Industry. NYC entertainment and intellectual property law attorney Ron Bienstock will be the telephonic guest speaker. He will discuss intellectual property issues in the recording and music industry; and the 2009 landmark trademark ruling he won against Fender, halting their efforts to trademark the body shape outlines of its Strat, Tele, and P-Bass models. This 2009 case was an important victory for the guitar industry as a whole because it prevented Fender from gaining a monopoly on body shapes that have been used by hundreds of manufacturers for half a century. The Trademark Board concluded that after more than 50 years in the market, the guitar body shapes had become generic because consumers did not solely associate them with the Fender brand. Fraud Counterclaims in the Court of Federal Claims. The guest speaker will be Elizabeth Wallace Fleming of Barokas Martin Tomlinson. She will cover an outline of “Fraud Counterclaims under the False Claims Act, Special Pleas in Fraud, and the CDA” as brought by DOJ in the Court of Federal Claims, especially since the 2006 Daewoo case where DOJ brought the fraud counterclaims after the trial had finished. Ms. Fleming will also discuss the legal basis for her belief that the tort of fraud invokes a 7th Amendment. right to a trial by jury. 1 General CLE Credit. Pizza will be served.
