Administrative Law

The Administrative Law section meets quarterly, but will not meet in March. The next regularly scheduled meeting is Monday, June 7, 2010, at 12 noon at the Bar office.

Admiralty Law

Alaska Native Law

The Alaska Native Law section will meet jointly with the Environmental/Natural Resources Law section on Wednesday, March 24, 2010, at 12 noon at in Room 1860 of the Atwood Building.  Note this one-time date change and room location change.

Subsistence. Pat Pourchot, Interior Secretary Ken Salazar’s Special Assistant for Alaska Affairs, will be the guest speaker. Mr. Pourchot will speak on subsistence. As additional information becomes available it will be emailed to section members.  1 General CLE Credit.

Alternative Dispute Resolution

The ADR section will meet on Thursday, March 11, 2010 at 12 noon at the Bar office.

Ethics and You! If you are looking to start the year with an hour of ethics CLE credit, and would enjoy a roundtable discussion of ADR-related ethics topics, please join us. There will also be a brief update on a possible Alaska Chapter of the Association for Conflict Resolution (ACR). 1 Ethics CLE Credit.

Appellate Law

The Appellate Law section meets every odd-numbered month. The first meeting will be held on Thursday, March 18, 2010, at 12 noon at the Department of Law, 5th Floor Conference Room (west side), 1031 W. 4th Avenue.  

Appellate Mediation Program.  Judge Elaine Andrews and Marilyn May, Clerk of the Appellate Courts, will be speaking about the appellate mediation program with the Alaska Supreme Court. 1 General CLE Credit.

Bankruptcy Law  

The Bankruptcy Law section will meet on Tuesday, March 30, 2010, at 12 noon at in the U.S. Trustee’s Hearing Room in the Bankruptcy Court, 605 W. 4th Avenue.

Common Procedural Mistakes. Amy McFarlane and Janet Stafford will discuss common procedural mistakes in dealing with the Bankruptcy Court including: noticing, timing, docketing, as well as ECF filing.  Amy and Janet will also cover changes to the official bankruptcy forms, new exemption amounts, and other dollar changes taking effect April 1, 2010, as well as upcoming changes to CM/ECF (Version 4 coming later this year).  Anyone with specific questions is invited to contact Amy or Janet directly at:  amy_mcfarlane@akb.uscourts.gov or janet_stafford@akb.uscourts.gov  1 General CLE Credit.

Corporate Counsel
The Corporate Counsel Law section will meet on Wednesday, March 17, 2010, 12 noon at Stoel Rives, 510 L Street, Suite 500.
"Corporations are people too!”-   That is what the US Supreme Court said in its landmark decision of Citizens United v. Federal Elections Commission, when it ruled that corporations are the equal of human beings when it comes to First Amendment free-speech rights.  The context of the case was political spending.   The State Attorney General has now issued an opinion stating that some of Alaska’s campaign financing laws are likely unconstitutional in light of this decision, but others are not impacted.   With the state and federal election campaigns gearing up, it is important you be able to guide your corporation through this maze of changing law.  JohnPtacin, Assistant Attorney General for the State of Alaska will lead the discussion.    1 General CLE Credit.  Pizza will be provided.

Family Law

Public Contracts

The Public Contracts section will meet on Tuesday, March 2, 2010, at 12 noon at Stoel Rives, 510 L Street, Suite 500.  PIZZA will be served.

“I Can’t Litigate On The Government’s Nickel Anymore?  Jeez, Tecom Has Ruined It For Everyone!”  Defense and settlement costs have historically been recognized by the Federal government as a cost of doing business and contractors have properly categorized these costs as allowable under the FAR.  However, a recent decision by the Federal Circuit in Geren v. Tecom, Inc. has changed the landscape, making these costs unallowable in many circumstances and positioning legal and settlement costs for much greater audit scrutiny.  Are you prepared?  Jessica Graham, Executive Vice President & General Counsel of Afognak Native Corporation, will lead a discussion of the Tecom decision and the changing analysis contractors must undergo when faced with employment litigation and other types of third party litigation.  1 General CLE Credit.

Real Estate Law

The Real Estate Law section will meet on Thursday, March 25, 2010, at 12 noon at the Bar office.

Real Property Law School Curriculum. Out of concern over the current status of the basic reall prperty course in law schools, the ABA Real Property, Trust and Estate Law Section created a Task force on Real Property Law School Curriculum.  The Task Force, with the assistance of the American Bar Foundation, issued a report which appeared in the September/October 2007 issue of Probate and Property.  In its Report, the Task Force made five recommendations which can be found in the following link to the Section’s webpage. www.alaskabar.org/servlet/content/Information_Distributed_at_Meetings_1254.html.This will be the topic of the March 25 meeting.  1 General CLE Credit.
