The technologies we use every day—found in computers and smart phones—transmit and store an ever-increasing amount of information about us: who we are, where we are, where we have been, what our interests are, who our friends are, and what we have been doing. When that information is requested as part of the search for evidence of criminal activity, courts are faced with growing challenges to understand both what can be retrieved and what privacy rights are implicated in allowing such searches. This session provides an overview of the types of information that can be gathered from computers, phones and the technical service providers we use and explores the standards courts consider when allowing the search for such information.
