Topics:
Community Property System: Alaska’s optional community property act using a community property agreement or joint revocable trust to opt into the act; tax and non-tax advantages of using Alaska community property. Perpetual Trusts (Dynasty Trusts): Use of a perpetual trust plan as the dispositive plan for our hypothetical client’s estate planning. Transfer tax and asset protection benefits for the client’s beneficiaries will be analyzed. Family Limited Liability Companies: Family limited liability companies for transfer tax minimization and asset protection planning. Domestic Asset Protection Trusts: Self-settled discretionary spendthrift trusts for both transfer tax minimization and asset protection; Alaska qualified personal residence trust.
